Appointment of unilingual Lieutenant-Governor of New Brunswick declared unconstitutional

On April 14, 2022, Chief Justice DeWare of the New Brunswick Court of Queen's Bench declared the appointment of a unilingual person to the position of Lieutenant-Governor of New Brunswick unconstitutional. The judge did not, however, overturn the appointment of Brenna Louise Murphy, the current Lieutenant-Governor, because of the multiple constitutional and political effects that such a decision would have. This declaratory judgment does however signal to the federal government that it must respect the equality of New Brunswick's two official languages and two official language communities.
