The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
Dans l’arrêt R c Jordan1, de 2016, la Cour Suprême du Canada s’est penchée sur le droit de subir son procès criminel dans un délai raisonnable protégé par l’alinéa 11b) de la Charte canadienne des droits et libertés2. La cour a statué qu’un délai de plus de 30 mois entre le dépôt des accusations et la conclusion réelle ou anticipée du procès, pour les affaires instruites devant les cours supérieures, est présumé déraisonnable. Cette présomption peut être réfutée par le ministère public s’il invoque des circonstances exceptionnelles qui sont raisonnablement inévitables, et auxquelles il ne doit pas y avoir un moyen raisonnable de remédier.
