The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
Introduction

Au cœur de l’arrêt Caron c. Alberta2 se trouve une question importante touchant aux droits linguistiques de la minorité francophone de l’Alberta. Caron et Boutet ont été accusés, dans des procédures distinctes, d’infractions routières prévues dans la Traffic Safety Act3 et le Use of Highway and Rules of the Road Regulation4, deux mesures législatives albertaines édictées en anglais seulement. Ils prétendent que la loi et le règlement sont inconstitutionnels parce qu’ils n’ont pas été édictés en français. Ils font aussi valoir que la Loi linguistique5 de l’Alberta est inopérante dans la mesure où elle abroge ce qui constitue une obligation constitutionnelle incombant à la province. La contestation de Caron et Boutet a été acceptée en première instance par la Cour provinciale6, mais rejetée par la Cour d’appel des poursuites sommaires7 et par la Cour d’appel de l’Alberta8. La question que devait trancher la Cour suprême du Canada était de savoir si la « Loi linguistique […] est ultra vires ou sans effet dans la mesure où elle abroge une obligation constitutionnelle de l’Alberta d’édicter, d’imprimer et de publier ses lois et ses règlements en français et en anglais »9.
