The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.

R. v. Munkonda, 2015 ONCA 309

(para 1) The appellant appeals from the decision of the Superior Court dismissing his application for certiorari. The certiorari judge found four violations of the appellant’s language rights, but nonetheless refused to grant a stay of proceedings or any other remedy. (para 1)
(para 2) The appeal raises important questions concerning the language rights of an accused at a bilingual preliminary inquiry or trial, as well as the procedure to be followed during those proceedings, and the remedies that a court should award as a result of a violation of those rights. (para 2)
