The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
In the matter before me the Notice of Motion is not in the standard form found in the Rules of Court of New Brunswick. It is not in both official languages. The grounds cited are deficient. The defendants did not reference the sub-rules of Rule 22 being relied on. If the forms are not in both of the official languages of our bilingual province, the Clerk’s Office has authority to reject a document at the stage of filing. I suspect that if a Clerk had reviewed the documentation upon filing, it would have definitely been rejected. The requirement that pleadings forms be in both official languages is an institutional requirement and consequently the gatekeepers should ensure that parties comply with Rule 4.08(3). Conformity with the Rules of Court of New Brunswick is important for clarity, jurisdiction and specificity of relief requested. Trial judges are directed by the Court of Appeal to insist on compliance with the Rules of Court. (para 9)
