The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.

[16]           Le Tribunal doit donc déterminer si l’enseignement reçu en anglais par le deuxième fils du requérant représente la majeure partie de son enseignement primaire, car c’est à cette condition que la fille du requérant peut fréquenter l’école anglaise au Québec. 

[17]           En apparence, l’expression « majeure partie » évoque des critères de quantité, mais en matière d’enseignement, il faut plutôt procéder à une analyse de nature qualitative, selon la Cour suprême. De là, la nécessité pour les parties d’aller plus loin qu’un simple décompte des jours d’enseignement dans chacune des deux langues.
