Since the parties in this case have decided to proceed in both official languages, I must, under section 19 of the OLD, be able to understand, without the assistance of an interpreter or simultaneous or consecutive translation, the two official languages used during the proceedings. Moreover, if the proceeding takes place, in whole or in part, in both official languages, as it is the case here, I have an obligation, in accordance with section 24 of the OLA to render my decision simulataneously in both languages. Section 43 of the Act, reproduced in its entirety in the attached schedule, describes the process for appointing a Commissioner and sets out the mandate and responsibilities of the Commissioner that has been appointed, including his or her role, powers and duties in dealing with the complaints he or she receives (ss. 43(9) to (12)). A complainant who is not satisfied with the conclusions made following the investigation conducted with respect to the complaint or with the resolution of the complaint may apply to the Court of King’s Bench. The referral judge may grant “such remedy as he or she considers appropriate and just in the circumstances” (ss. 43(18) and (19)). |
