The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.

[1] M. Thibodeau a présenté une plainte au Commissaire aux langues officielles [le Commissaire] à l’égard de l’Administration des aéroports régionaux d’Edmonton [l’AARE]. Après enquête, le Commissaire a conclu que l’AARE a violé plusieurs dispositions de la Loi sur les langues officielles, LRC 1985, c 31 (4e suppl) [la Loi]. 

[2] M. Thibodeau présente maintenant une demande à notre Cour visant notamment à obtenir une déclaration portant que l’AARE a violé la Loi et une condamnation à des dommages-intérêts au montant de 7500 $. Bien que l’AARE admette maintenant avoir violé la Loi, elle soutient qu’elle ne devrait pas être condamnée à payer des dommages-intérêts. Selon l’AARE, M. Thibodeau serait un plaignant à répétition qui recherche activement des violations de la Loi, et son modus operandi équivaudrait à une « marchandisation » des droits garantis par la Loi. L’AARE affirme également qu’elle s’est conformée à la Loi depuis le dépôt des plaintes. 

[3] J’accueille la demande de M. Thibodeau et je condamne l’AARE à verser à celui-ci des dommages-intérêts au montant de 5000 $. J’estime que l’octroi de dommages-intérêts est nécessaire pour assurer la défense des droits reconnus par la Loi et la dissuasion. Rien dans le modus operandi de M. Thibodeau n’écarte cette nécessité, et l’AARE n’a pas présenté de preuve qu’elle s’est conformée à la Loi à la suite du rapport du Commissaire.


 
 

[1] Mr. Thibodeau made a complaint to the Commissioner of Official Languages [the Commissioner] regarding the Edmonton Regional Airports Authority [ERAA]. After conducting an investigation, the Commissioner found that ERAA had violated several provisions of the Official Languages Act, RSC 1985, c 31 (4th supp) [the Act]. 

[2] Mr. Thibodeau is now applying to this Court for a declaration that ERAA breached the Act and for an award of damages in the amount of $7,500. While ERAA now admits to having breached the Act, it asserts that it should not be ordered to pay damages. According to ERAA, Mr. Thibodeau is a serial complainant who actively seeks out violations of the Act, and that his modus operandi amounts to a “commodification” of the rights guaranteed by the Act. ERAA also states that it has complied with the Act since the complaints were filed. 

[3] I am allowing Mr. Thibodeau’s application and ordering ERAA to pay him damages in the amount of $5,000. I find that awarding damages is necessary to the vindication of the rights recognized by the Act and deterrence. Nothing about Mr. Thibodeau’s modus operandi changes this, and ERAA has not presented any evidence that it has become compliant with the Act since the Commissioner’s report was issued.
