The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
Après l’audience de cette question, j’ai donné une directive aux parties en vue de les informer que la Cour envisageait d’appliquer l’alinéa 20(1)a) de la Loi sur les langues officielles, LRC 1985, ch. 31 (4e suppl.) [la Loi] à la publication de la décision en l’espèce. J’ai ordonné à chacune des parties de signifier et de présenter toute observation qu’elle souhaite invoquer concernant l’application éventuelle de l’alinéa 20(2)b) de la Loi. Le défendeur n’a présenté aucune telle observation. Le demandeur a présenté des observations, lesquelles sont examinées ci-dessous. (para 38) Following the hearing in this matter, I issued a Direction to the parties, informing them that the Court was considering the application of s. 20(1)(a) of the Official Languages Act, RSC 1985, c. 31 (4th Supp) [the Act] to the issuance of the decision in this matter. I directed that each of the parties serve and file any submissions the party may wish to make on the potential application of s. 20(2)(b) of the Act. The Respondent did not make any such submissions. The Applicant did make submissions, which are addressed below. (para 38) 


L’alinéa 20(1)a) de la Loi dispose que [l]es décisions définitives -- exposé des motifs compris -- des tribunaux fédéraux sont simultanément mises à la disposition du public dans les deux langues officielles si le point de droit en litige présente de l’intérêt ou de l’importance pour celui-ci. Toutefois, conformément au paragraphe 20(2) de la Loi, si le tribunal estime que l’établissement d’une version bilingue entraînerait un retard qui serait préjudiciable à l’intérêt public ou qui causerait une injustice ou un inconvénient grave à une des parties au litige, la décision -- exposé des motifs compris -- est rendue d’abord dans l’une des langues officielles, puis dans les meilleurs délais dans l’autre langue officielle. Elle est exécutoire à la date de prise d’effet de la première version. (para 39)

Section 20(1)(a) of the Act provides that any final decision, order or judgment, including any reasons given therefor, issued by any federal court shall be made available simultaneously in both official languages where the decision, order or judgment determines a question of law of general public interest or importance. However, pursuant to s. 20(2)(b) of the Act, where the court is of the opinion that to make the decision, order or judgment, including any reasons given therefor, available simultaneously in both official languages would occasion a delay prejudicial to the public interest or resulting in injustice or hardship to any party to the proceedings leading to its issuance, it shall be issued in the first instance in one of the official languages and thereafter, at the earliest possible time, in the other official language, each version to be effective from the time the first version is effective. (para 39)
Même si j’estime que la question certifiée en l’espèce est un de droit en litige qui présente de l’intérêt ou de l’importance pour le public, les observations du demandeur m’ont convaincu qu’il éprouverait des difficultés ou une injustice si la publication de cette décision était retardée aux fins de traduction. M. Farah explique qu’il rencontre maintenant des agents de l’Agence des services frontaliers du Canada en vue de préparer son renvoi, qu’il prépare son dossier de demande afin de demander l’autorisation et le contrôle judiciaire de la décision défavorable concernant l’ERAR et qu’il pourrait demander de façon imminente le sursis de la mesure de renvoi dont il est frappé. Il mentionne le stress et les difficultés psychologiques découlant de l’incertitude de sa situation qui pourraient être allégés quelque peu en connaissant l’issue de cette affaire. Je conclus que le fait d’exiger que M. Farah poursuive les recours qu’il a mentionné sans connaître l’issue de sa présente demande de contrôle judiciaire lorsque la Cour a tranché la question constituerait une injustice et un préjudice. Par conséquent, la présente décision sera publiée en anglais et la traduction française sera ensuite publiée, conformément au paragraphe 20(2) de la Loi. (para 40) While I consider the question certified in this matter to be a question of law of general public interest or importance, I am persuaded by the Applicant’s submissions that he would suffer hardship or injustice if the issuance of this decision was delayed to allow for translation. Mr. Farah explains that he is now in the process of meeting with the Canada Border Services Agency to prepare for removal, that he is preparing his Application Record in an application for leave and judicial review of the negative PRRA decision, and that he may imminently be moving for a stay of his removal. He refers to stress and psychological hardship due to the uncertainty of his situation, which would be relieved somewhat by knowing the outcome of this matter. I find that it would represent an injustice and hardship to require Mr. Farah to pursue the remedies to which he refers, without knowing the result of the present application for judicial review, when the Court has made its decision in this matter. Therefore, this decision is being released in English, with the French translation to follow, in accordance with s. 20(2)(b) of the Act. (para 40)
