The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
Le substitut du procureur général a, à juste titre, porté à notre attention le fait que Mme Petitpas, lors de sa première comparution, a clairement indiqué, par l’entremise de son avocat, son choix de subir son procès en anglais. Elle a pu signifier, en anglais, son choix de subir son procès devant la Cour du Banc de la Reine, après une enquête préliminaire. Toutefois, à partir de ce moment-là, pour des raisons qui ne ressortent pas de façon évidente du dossier, l’instance s’est déroulée en français uniquement. (para 3) Counsel for the Attorney General quite properly brought to our attention the fact that, at her first appearance, Ms. Petitpas clearly indicated, through her counsel, her choice to proceed in the English language. Her election to be tried in the Court of Queen’s Bench after a preliminary inquiry proceeded in English. However, from that point onward, for reasons that are not obvious from the record, the proceedings were conducted entirely in French. (para 3)

Comme l’a fait remarquer, à bon droit, le substitut du procureur général, le dossier ne laisse aucun doute qu’il y a eu, en l’espèce, violation de l’art. 530 du Code criminel, L.R.C. 1985, ch. C-46. Il n’a pas été tenu compte du choix de langue de Mme Petitpas. Comme le juge Bastarache l’a affirmé dans l’arrêt R. c. Beaulac, [1999] 1 R.C.S. 768, [1999] A.C.S. no 25 (QL), "le par. 530(1) crée un droit absolu". En l’espèce, la Cour aurait dû rendre une ordonnance portant que l’affaire soit entendue par un juge qui parlait la langue choisie par Mme Petitpas et les exigences prévues à l’art. 530.1 auraient alors dû être remplies. On a complètement fait abstraction de ces exigences. (para 4) As counsel for the Attorney General has rightly pointed out, the record leaves no doubt there has been, in this case, a violation of s. 530 of the Criminal Code, R.S.C., 1985, c. C-46. Ms. Petitpas’ choice of language was disregarded. As Bastarache J. states in R. v. Beaulac, [1999] 1 S.C.R. 768, [1999] S.C.J. No. 25 (QL), "s. 530(1) creates an absolute right". In this case, there should have been an order that the matter be tried before a judge who spoke Ms. Petitpas’ chosen language and the requirements of s. 530.1 should then have been followed. These requirements were wholly ignored. (para 4)
Eu égard aux circonstances, nous concluons qu’il convient d’accueillir l’appel, d’annuler la déclaration de culpabilité et d’ordonner la tenue d’un nouveau procès. Voilà le dispositif de la Cour. (para 5) In the circumstances, we conclude that it is proper for us to allow the appeal, set aside the conviction and order a new trial. Such is the disposition of the Court. (para 5)
