The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.

2 L’article 9 de la Loi est abrogé et remplacé par ce qui suit : 2 Section 9 of the Act is repealed and the following is substituted:
9(1) Si une personne physique présente la demande prévue à l’article 7 et que le document contenant des renseignements personnels sur la santé n’est pas disponi-ble dans la langue officielle de son choix, le dépositaire auquel la Loi sur les langues officielles s’applique prend les mesures nécessaires pour qu’un médecin ou quelque autre fournisseur de soins de santé l’aide à interpréter son document. 9(1) If an individual makes a request under section 7 and the individual’s record containing personal health information is not available in his or her official language of choice, a custodian to whom the Official Languages Act applies shall provide the individual with access to a physician or other health care provider to assist the individual in interpreting the record.
9(2) S’il l’estime indiqué, le dépositaire auquel la Loi sur les langues officielles s’applique peut traduire ou faire traduire les parties pertinentes du document conte-nant des renseignements personnels sur la santé d’une personne physique pour les besoins du médecin unilingue qui la traite, si le médecin ne comprend pas la langue officielle dans laquelle celui-ci est établi. 9(2) If a custodian to whom the Official Languages Act applies considers it appropriate, the custodian may translate or cause to be translated the relevant provisions of an individual’s record containing personal health information for the purpose of a unilingual physician treating the individual if the record is in an official language the physician cannot understand.
