(i) close the school or discontinue one or more grades taught in the school if, before the effective date of the closure or the discontinuance, the conseil scolaire has obtained the consent of the conseil d’école of the school to the closure or the discontinuance, as the case may be; or |
| (ii) soit, sous réserve du paragraphe (2), la fermer ou cesser d’y offrir une ou plusieurs années d’études, à condition d’avoir : |
(ii) subject to subsection (2), close the school or discontinue one or more grades taught in the school if: |

| 181(1) Tout adulte de langue minoritaire qui ne réside pas dans la division scolaire francophone et qui est le père ou la mère d’un enfant qui n’a pas encore atteint l’âge de 22 ans peut demander au conseil scolaire, de la façon prévue par celui-ci, de fournir un programme de scolarisation en langue minoritaire à son enfant. |
181(1) Any minority language adult who is not a resident in the division scolaire francophone and who is the parent of a child who has not yet attained the age of 22 years may apply to the conseil scolaire, in the manner required by the conseil scolaire, for the provision of a minority language education program for that child. |
| (2) Saisi d’une demande présentée en vertu du paragraphe (1), le conseil scolaire est tenu de prendre en compte les facteurs suivants pour décider s’il y a lieu d’offrir le programme de scolarisation en langue minoritaire demandé : |
(2) If a request is received pursuant to subsection (1), the conseil scolaire shall consider the following factors in determining whether to offer the minority language education program requested: |
| a) la capacité d’offrir les services pédagogiques qui conviennent; |
(a) whether the appropriate services, in pedagogical terms, can be offered; |
| b) l’existence d’au moins une école fransaskoise à proximité immédiate qui pourrait satisfaire aux besoins des élèves; |
(b) whether there is an existing fransaskois school or schools in close proximity that could meet the needs of the pupils; |
| c) l’existence d’une demande de services d’éducation en français dans la région où réside l’adulte de langue minoritaire; |
(c) whether there is a demand for francophone education in the area in which the minority language adult resides; |
| d) la présence d’autres adultes de langue minoritaire dans la région qui ont des enfants de moins de 22 ans et qui seraient intéressés à se prévaloir des services demandés; |
(d) whether there is an indicated interest among other minority language adults, who each have one or more children not yet 22 years of age, in the area who would take advantage of the service; |
| e) le caractère raisonnable des déplacements que les élèves devraient effectuer; |
(e) whether the distances over which the pupils would be required to be transported are reasonable; |
| f) la disponibilité des installations nécessaires; |
(f) whether physical facilities may be made available; |
| g) le caractère raisonnable du coût des services demandés; |
(g) whether the cost of the requested services is reasonable; |
| h) l’existence d’une demande suffisante dans la région pour justifier : |
(h) whether there is sufficient demand in the area to justify: |
| (i) la modification des limites de la zone de fréquentation, |
(i) the alteration of the attendance area boundaries; |
| (ii) la constitution d’une région scolaire francophone, |
(ii) the establishment of a francophone education area; or |
| (iii) l’agrandissement de la division scolaire francophone; |
(iii) the expansion of the division scolaire francophone; |
| i) l’existence de tout autre motif, fondé sur les facteurs ou considérations qu’il estime indiqués, justifiant le refus de fournir le programme de scolarisation en langue minoritaire demandé ». |
