The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
1 L’article 11 de la Loi sur la délimitation des circonscriptions électorales et la représentation, chapitre 106 des Lois révisées de 2014, est abrogé et remplacé par ce qui suit : Section 11 of the Electoral Boundaries and Representation Act, chapter 106 of the Revised Statutes, 2014, is repealed and the following is substituted:
11(1) Sous réserve des paragraphes (3), (4), (5) et (6), lorsqu’elle divise la province en circonscriptions électorales, la commission veille à ce que le nombre d’électeurs dans chacune d’elles se rapproche le plus raisonnablement possible du quotient électoral.  11(1) Subject to subsections (3), (4), (5) and (6), when dividing the Province into electoral districts, a Commission shall ensure that the number of electors in each electoral district is as close as reasonably possible to the electoral quotient.
11(2) Lorsqu’elle divise la province en circonscriptions électorales, la commission prend en compte la représentation effective des communautés linguistiques française et anglaise dans l’application de l’article 3 de la Charte canadienne des droits et libertés. 11(2) When dividing the Province into electoral districts, a Commission shall consider the effective representation of the English and French linguistic communities in complying with section 3 of the Canadian Charter of Rights and Freedoms.
11(3) Afin de remplir ses obligations prévues au paragraphe (2), la commission peut déroger au principe de parité électorale énoncé au paragraphe (1) 11(3) In order to comply with its obligations under subsection (2), a Commission may depart from the principle of voter parity as set out in subsection (1).
11(4) La commission peut déroger au principe de parité électorale énoncé au paragraphe (1) afin d’atteindre la représentation effective de l’électorat tel que le garantit l’article 3 de la Charte canadienne des droits et libertés et en se fondant sur les facteurs suivants :  11(4) A Commission may depart from the principle of voter parity as set out in subsection (1) in order to achieve effective representation of the electorate as guaranteed by section 3 of the Canadian Charter of Rights and Freedoms and based upon the following considerations:
 a) les communautés d’intérêts;  (a) communities of interest;
 b) les limites municipales et autres limites administratives; (b) municipal and other administrative boundaries;
 c) le taux de croissance de la population dans une région; (c) the rate of population growth in a region;
 d) la représentation effective des régions rurales; (d) effective representation of rural areas;
 e) les caractéristiques géographiques d’une région, y compris : (e) geographical features, including the following:
 (i) son accessibilité, (i) the accessibility of a region;
 (ii) sa superficie,  (ii) the size of a region; and
 (iii) sa configuration; (iii) the shape of a region; and
 f) tous autres facteurs jugés pertinents.  (f) any other considerations that the Commission considers appropriate.
11(5) Dans l’établissement d’une circonscription électorale, si elle est d’avis qu’une dérogation au principe de parité électorale est souhaitable, la commission peut néanmoins n’y faire dévier le nombre d’électeurs que de 15 % tout au plus du quotient électoral.  11(5) If a Commission is of the opinion that it is desirable to depart from the principle of voter parity when establishing an electoral district, the number of electors in the electoral district shall deviate by no greater than 15% from the electoral quotient.
11(6) Dans l’établissement d’une circonscription électorale, si elle est d’avis qu’une dérogation au principe de parité électorale est souhaitable, la commission peut néanmoins, dans des circonstances exceptionnelles, n’y faire dévier le nombre d’électeurs que de 25 % tout au plus du quotient électoral. 11(6) If a Commission is of the opinion that it is desirable to depart from the principle of voter parity when establishing an electoral district, in extraordinary circumstances the number of electors in the electoral district may deviate by no greater than 25% from the electoral quotient.
11(7) Il est entendu que le terme « circonstances exceptionnelles » mentionné au paragraphe (6) comprend la représentation effective des communautés linguistiques française et anglaise.  11(7) For greater certainty, “extraordinary circumstances” in subsection (6) includes the effective representation of the English and French linguistic communities.
