The International Observatory on Language Rights

The International Observatory on Language Rights aims, on the one hand, to promote the vitality of minority language communities in Canada by urging these communities to take part in the development of their rights and, on the other hand, to acquaint other countries with the Canadian experience by sharing with them how Canada has dealt with its official languages problems. Conversely, the Observatory hopes to help Canadians gain better insight into the linguistic situation in other countries, thereby providing an opportunity to learn from their experience, and offering different problem-solving avenues.
INTRODUCTION

La Loi sur les langues officielles1(LLO)du Nouveau-Brunswick prévoit que les agents de la paix2 doivent, lorsqu’ils communiquent avec un individu, l’informer de son droit de communiquer dans l’une des deux langues officielles de la province. Bien que les agents de la paix de la province soient informés de cette obligation, bon nombre d’entre eux y ont failli au fil des ans.

Dans cet article, nous nous proposons d’examiner l’étendue de l’obligation d’offre active qu’ont les agents de la paix du Nouveau-Brunswick. Quand doivent-ils offrir le choix de la langue à l’individu, comment doivent-ils en informer l’individu, pourquoi doivent-ils faire une offre active de service et quelles sont les conséquences qui peuvent découler d’un manquement à cette obligation.
