L’Observatoire international des droits linguistiques

Les 28, 29 et 30 octobre 2022, l’Observatoire international des droits linguistiques et l’Association acadienne des artistes professionnel.le.s du Nouveau-Brunswick organisent à Moncton un colloque qui portera sur les enjeux qui entourent la réglementation des plateformes de vidéo sur demande au Canada (Netflix, Amazon prime, Disney+, Apple Tv, etc.), notamment de l'impact du projet de loi C-11. Les discussions tourneront autour de trois champs d'intérêt en particulier: le droit, la culture et l'épanouissement des communautés francophones en situation minoritaire.

An opinion piece written by the Director of the International Observatory on Language Rights, Professor Érik Labelle Eastaugh, was published in the Telegraph Journal today, supporting the declaration of the unconstitutionality of the appointment of a unilingual person to the position of Lieutenant-Governor of New Brunswick. The article is intended to clarify certain principles regarding the substantive equality of New Brunswick's two official languages and two official language communities, and demonstrates the validity of the decision of Justice DeWare, Chief Justice of the Court of Queen's Bench of New Brunswick.

On April 14, 2022, Chief Justice DeWare of the New Brunswick Court of Queen's Bench declared the appointment of a unilingual person to the position of Lieutenant-Governor of New Brunswick unconstitutional. The judge did not, however, overturn the appointment of Brenna Louise Murphy, the current Lieutenant-Governor, because of the multiple constitutional and political effects that such a decision would have. This declaratory judgment does however signal to the federal government that it must respect the equality of New Brunswick's two official languages and two official language communities.
